Moreland subtenancy ruling will not be heard by the Lords

The House of Lords has dismissed an application from a statutory tenant of a residential property to challenge an Appeal Court ruling that he had not been lawfully entitled to sublet the premises, because he had not occupied them for some five years.

The tenant had intended to challenge the Appeal Court finding last October in favour of landlord Moreland Properties (UK) Ltd.

In the Court of Appeal, Moreland succeeded in challenging a Barnet County Court ruling that it was not entitled to possession of the property in Long Lane, Finchley, London N3.

The Appeal judges backed Moreland in its claims that the statutory tenant, Dahya Dhokia, had not been entitled to grant a subtenancy of the premises when he was not in possession of them.
