On the Case: Lessons for developers from Supreme Court’s Alexander Devine ruling

LISTEN Chris Stoner QC and Andrew Francis from Serle Court Chambers dissect the Supreme Court decision in Alexander Devine Children’s Cancer Trust v Housing Solutions Ltd [2020] UKSC 45; [2020] PLSCS 201.

The case involved what was found to be a “cynical breach” by a developer of a restrictive covenant, the benefit of which was enjoyed by a charity.

Stoner and Francis analyse the court’s findings in detail, address its implications and explain why the case is a clear warning for developers to take restrictive covenants seriously.
