A property investor has been ordered to pay £1m in costs after losing a legal battle over noises in his Fitzroy Place flat, W1.
Nazirali Tejani paid nearly £2.6m 10 years ago for an off-plan flat in Fitzroy Place, billed as London’s first new garden square for more than a century. He told the High Court that, shortly after occupying the property near Oxford Street, noises “akin to popping bubble wrap” permeated the flat and disturbed his sleep.
Despite extensive remedial work, the sound remained and Tejani sued the freeholder and developer for about £1m.
Judge Veronique Buehrlen KC dismissed Tejani’s claim as “weak” and ordered him to pay the legal costs of the case, estimated at more than £1m. She said Tejani should have settled the dispute with the developers.
