The owners, property managers and social landlords of London Olympic Village have filed a High Court lawsuit against the builder and environmental consultant who worked on the construction of the project.
The case was filed yesterday on behalf of property management company East Village Management, its parent company and freeholder Get Living and social housing provider Triathlon Homes in the Technology and Construction Court division of the High Court.
According to the filing, the three brought the claim against builder Ardmore Construction and environmental building and engineering consultancy Wallace Whittle.
Less than two weeks ago, Get Living and Triathlon were embroiled in a legal dispute of their own. Triathlon sued Get Living to pay for the replacement of cladding.
Triathlon won the case, which took place in specialist property court the First-tier Tribunal. On 19 January, the tribunal ordered Get Living and a subsidiary company to pay £18m towards the works.
Work to replace the cladding was already underway and being managed by East Village Management using a grant from the government’s Building Safety fund.
In an interview last week, Richard Gerstein, a dispute resolution partner at Mishcon de Reya who represented Get Living in the case, said further legal action was necessary.
The dispute “is about the short-term funding of the works, pending recovery from the contractors or designers who were actually responsible for the problem”, said Gerstein.
Ardmore and Wallace Whittle did not respond to a request for comment.
