Estate agents were celebrating this week after a court backed a new wording for sole selling rights in agency contracts.
The wording follows a Court of Appeal decision last year which led to chaos among estate agents on sole agency terms, who realised that they would be denied commission where sales were made through third parties and contracts exchanged outside the sole agency period.
The new wording replaces the contentious words “introduced to you” in the regulations, which the Court of Appeal construed as “introduced to you by us”.
The new clause reads: “introduced to you by anyone during that period whether by us or by any other agent or yourself”.
