Judge Richard Havery QC has handed down his judgment in the case of Prudential Assurance Co Ltd v McBains Cooper and others in similar terms to an earlier draft.
The case, which involved a claim by Prudential for breach of contract in relation to a structural survey carried out by McBains, became the subject of a Court of Appeal hearing when the parties objected to the judge’s decision to formally hand down judgment after they had reached a settlement based on his draft.
