The Royal Brompton Hospital National Health Service Trust has launched an Appeal Court challenge to a High Court decision blocking seven grounds of a massive legal claim over its new premises in Chelsea. Royal Brompton alleges that the High Court ruling could potentially reduce the claim by £6m.
The hospital is asking Aldous, Clarke and Laws LJJ to overturn last Novembers decision striking out seven of its 10 claims against a number of project managers, architects and mechanical and electrical services engineers for breach of contract and negligence.
Royal Brompton claims that the development of phase 1 of the project, which began in March 1987, was completed 43 weeks late in May 1990, and is seeking millions of pounds in damages for the delay.
The latest moves follows a lengthy period of litigation and arbitration between the hospital and main contractor Taylor Woodrow Construction Holdings Ltd.
The hearing is expected to last until the end of the week.
