Earl of Cardigan waits for right-of-way decision

The Earl of Cardigan must wait to find out whether his neighbour will be awarded a right of way to travel across his land.

The High Court has reserved judgment in the case, in which William Smith seeks a right of way over a track on the land belonging to the trustees of the Savernake Estate, the Earl of Cardigan and David Shorey.

The trustees admit that Mr Smith is entitled to an easement over part of the track but claim that they are entitled to exclusive possession of the easternmost section between the cottage and the A346. The trustees also seek an injunction preventing Mr Smith from passing over that section.
