Livingstone will not appeal against Tube court defeat

London mayor Ken Livingstone and his transport commissioner, Bob Kiley, will not appeal against the High Court’s rejection of their call for a judicial review of the Government’s proposed PPP for London Underground.

In a joint statement, Livingstone and Kiley said that they had decided against an appeal after being told that it was “unlikely to succeed”. However, Livingstone and Kiley made it clear that they would not give up the fight against what they call “Tube privatisation”.

Drawing attention to the as-yet-unpublished Deloitte Touche report on whether or not the PPP will provide value-for-money, Kiley and Livingstone added: “As mayor and commissioner, we will continue to use all appropriate means to enforce London’s rights in this matter.”
