The University of Leeds has succeeded in its High Court challenge to Leeds City Council’s unitary development plan, which, it claimed, blocked any development on playing fields at Lawnswood, to the south of Bodington Hall, Weetwood.
Richards J has quashed the part of the UDP in which the council set the land aside as open land, after plans to develop a shopping complex on the site were shelved.
He said that the universitys challenge had been well-founded and that the council had proceeded on a material misdirection.
Backing the university, he said that the council had adopted a mistaken and unreasonable interpretation of the inspectors report, and its decision not to reopen a public inquiry into the matter had been based, in part, on that misdirection.
