Stephen Byers, who resigned as transport secretary on Tuesday, would remain the key witness in any court case that Railtracks private shareholders bring, David Greene, head of solicitors Edwin Coe, said.
The lawyer, representing private shareholders, said technically they would bring a case for misfeasance against the new secretary, Alistair Darling, but Byers was central to the whole case and his evidence would be “crucial”.
The action group will reveal the findings today of its QC, Michael Crystal into its case for more compensation.
