Carphone Warehouse is being sued by landlord Hemingway Investments over the lease of its Oxford shop premises. Hemingway claims that the company has breached the lease by subletting the unit to a shop selling discounted household goods.
Carphone Warehouse allegedly took an assignment of a lease of premises at 32 St Ebbes Street, Oxford, under which it was allowed to sell electrical and electronic goods and services.
Hemingway, of Devonshire Street, London, claims that, in breach of covenants, the company parted with possession of the shop by allowing a Mr Mirpuri and others into occupation of the premises, at a weekly rent of £425.
Hemingway claims that this took place without permission, and that it breached the terms of the lease. It claims that, despite requests, Carphone Warehouse has failed to remedy the breaches.
Hemingway is now seeking injunctions banning Carphone Warehouse from parting with possession or underletting the shop, forcing it to remove the occupier, and banning it from using the shop for purposes unauthorised by the lease. It is also seeking unspecified damages for breach of covenant.
