BP Oil UK Ltd has succeeded in its attempt to revive a claim for compensation over the compulsory purchase of part of a former petrol filling station in Herne Bay.
Allowing the appeal, Carnwath LJ said that he was satisfied, on an ordinary reading of the February 1996 agreement, that BP had obtained contractual rights that were enforceable, notwithstanding any statutory limit that would arise apart from the agreement.
