Goldmile Properties is suing United Utilities Water plc for more than £1.7m in a dispute over premises at Newtown House in Buttermarket Street, Warrington.
In a writ issued at London’s High Court and just made publicly available, Goldmile seeks £1,714,877 in respect of, among other things, alleged breaches of repairing and decorating covenants of the premises. Goldmile claims that the water company breached the lease by failing to keep the interior and the landlord’s fixtures in good and tenantable repair and condition.
The lease expired on 14 May 2001, but Goldmile maintains that United Utilities failed to carry out repairs and yield up the premises in the condition required.
The claim states that Goldmile served a schedule of dilapidations on 1 February 2002, requiring United Utilities to reinstate the premises, but alleges that the water company has failed to do so.
Goldmile says that the cost of repair work is estimated at more than £1m, and lost rent during the works is calculated at just over £210,000. Together with other costs, the estimated total loss amounts to £1,714,877.25.
