The Court of Appeal is to hear a dispute over a right of way between plots of land on the site of a former village farmyard, known as Home Farm, in Fulbeck, Lincolnshire. The plots were acquired with outline planning permission for residential development.
In May 2002, Alan Valentine, the owner of one of the plots, sought injunctions, and claimed damages for alleged trespass, against Kevin Allen and John and Alison Nash, the owners of other plots.
Judge Inglis, sitting in Lincoln County Court, rejected Valentine’s claims and held that Valentine had no right of way onto his property.
Valentine is challenging that ruling.
