Neuberger LJ has underlined the growing expertise of the Chancery Division in property-related cases, an evolution that may, he noted, ultimately lead to judges specialising in hearing certain types of cases.
The comments, made in his opening address to the Property Litigation Association at its annual conference, are part of an ongoing change to the civil courts that has resulted in increased judicial power, particularly over the last decade.
The strengthening of these powers has been sparked, he said, by a requirement to interpret ever-increasing amounts of legislation, and is likely to be consolidated further by the establishment of the Supreme Court.
Other speakers at the conference, held on 7 and 8 April at Keble College, Oxford, included Liz Peace, Chief Executive of the British Property Federation and Barry Gilbertson, President of the RICS.
