Spring date set for Candy/Qatari battle

 


The battle between the Candy brothers and Qatari Diar over the Chelsea Barracks scheme will take place this spring, a high court judge has ruled.


 


This morning, Mr Justice Peter Smith ruled that a 5-8 day trial of the dispute will take place at some time between 22 April and 10 May this year.


 


A previous decision of the high court in December 2009, which refused a speedy trial of the dispute, was thereby changed in view of a recently available gap in the court schedule that can accommodate the dispute without prejudice to other litigants.


 


The judge said that it was important for the matter to be dealt with before a new planning application is submitted by the Qataris to Westminster council in July.


 


The dispute centres on the 12 June decision by the Qataris to withdraw the parties’ joint planning application for a Lord Rogers’-designed luxury residential redevelopment of the 12.5-acre site.


 


The Candy’s CPC Group claims that the Qataris told the company the plans had been withdrawn and the contract annulled after London mayor Boris Johnson stated that he would use planning powers to veto the proposals.


 


However, CPC alleges that the proposals were unilaterally and wrongfully withdrawn by the Qataris despite its objections after the intervention of Prince Charles, who preferred an alternative design by architect Quinlan Terry.
