Tesco waves white flag in Liverpool

Supermarket giant Tesco has conceded defeat in its battle to build a 90,000 sq ft superstore in a key regeneration area of north Liverpool.

Tesco has said it will not appeal a June High Court ruling upholding planning refusal for its proposed store on Great Homer Street in the Everton area of the city.

It has also indicated that it will seek to sell its land at Great Homer Street to developer St Modwen, which is promoting a rival regenerations project for the site.

Last month, Tesco’s legal challenge to St Modwen’s and Liverpool council’s £150m Project Jennifer was rejected to Manchester High Court.

Tesco had been pursuing a legal challenge after its planning application for the site was rejected at the end of last year by a planning inspector following a public inquiry. The supermarket chain argued that the inspector’s decision was wrong on a point of law.

Tesco’s decision to drop its objections allows St Modwen to press ahead with Project Jennifer, which will create 481 new homes, community facilities, a 110,000 sq ft Sainsbury’s store, 80,000 sq ft of non-food retail and public realm improvements at the site on Great Homer Street in the Everton area of Liverpool.

A Tesco spokesman said: “We were disappointed with the recent legal decision as we had an exciting development proposed for Great Homer Street. However we recognise that the council wants to see the total regeneration of the area happen sooner rather than later.

“Following discussions with the council we will now enter negotiations to sell our land, which would remove any reasons for further delay.”
