Construction manager sues owners of Fulham football ground

Construction manager Kud International, and its associated company Kud Ltd, are suing the owners of Fulham’s football ground and stadium following the termination of their contract to manage the construction of a new £75m stadium at Craven Cottage.

The claimants are suing Fulham Stadium Ltd, as the owner of Craven Cottage, as well as Fulham Football Club (1987), Fulham Football Club Ltd and Fulham Football Club, an unincorporated association, for allegedly outstanding management fees of £240,710.94, plus interest. Alternatively, the companies are seeking damages for breach of contract, plus interest.

Fulham Stadium was given permission to build the stadium in February 2001. The claimants contend that, in August 2001, Kud and Michael Fiddy, of Fulham Football Club, signed an agreement, under which Kud was to be paid £1.625m for managing the development and providing a completion guarantee, a pre-construction fee of £243,750, and £162,500 once construction commenced.

The claimants maintain that the agreement was binding and that Fiddy signed the agreement as agent for the three companies and the association being sued. They are seeking payment of the monthly fees of £40,625 between August and December 2001.
