Court orders dissolution of property partnership

The High Court has today ordered the sale of a London property, having found that a 1988 partnership formed by a carpenter, a central-heating engineer and a bricklayer to develop the property had become unworkable and should be dissolved.

Deputy Judge David Young QC allowed a claim for dissolution of the partnership by carpenter Mukhtiar Singh Khurll. He rejected a claim by the engineer, Trevor Poulter, that the partnership had already been dissolved in 1991 or 1996.

The judge ordered the sale of 97 Alfriston Road, London SW11, which has been converted into three flats by Khurll, Poulter and the third partner, Richard Moreira.

He said: “I have no doubt that the partnership between Mr Khurll and Mr Poulter and Mr Moreira, which I have found to subsist, has become unworkable. Dissolution is sought by Mr Khurll and Mr Moreira and Mr Poulter seeks declarations that the partnership has already been dissolved.

“There is clearly no longer any trust between the partners, and it is just and equitable that it should be dissolved in accordance with the Partnership Act 1890 and accordingly wound up.”
