The High Court has ordered the sale of
Last week, Coulson J ordered the sale under a final charging order. This had been issued in October 2009 in favour of the development’s engineering consultant Packman Lucas to secure the payment by a Jersey-based vehicle run by Halabi of more than £190,000 in disputed fees, interest and legal costs.
Also appearing at the hearing as an interested party was the development’s architect, Aukett Fitzroy Robinson (AFR), which also has a final charging order against the property to secure the payment by Halabi vehicles of £1.1m in disputed fees, interest and costs.
After hearing evidence from the parties as to the minimum value to be placed on the property the judge ruled that an appropriate price would be £16m.
The judge refused to order the sale of further properties at 21 Charles Street and 20 and 21 Hay Mews in Mayfair, London, under a separate final charging order of more than £26,000 on the grounds that it could affect a possible imminent sale and the disparity between the size of the judgment debt and the £26.5m price of the property.
