Cultivate a broad knowledge of agricultural law

In his article “Avoiding agricultural pitfalls” published in May 2019, Simon Blackburn highlighted some of the obstacles facing a landowner who is trying to develop part (or even the whole) of a farm let by him. This article addresses further issues that the landowner may need to consider.

The planning dimension

Whether the agricultural tenancy is governed by the Agricultural Holdings Act 1986 (the 1986 Act) or the Agricultural Tenancies Act 1995 (the 1995 Act), the landowner’s first concern is to achieve planning. As to that, the tenant is (in the absence of an agreement to give up tenanted rights) likely to oppose the planning application.
