A long-running dispute over registration of a tidal beach as a town or village green (TVG) will come to an end at the Supreme Court next week.
Lord Neuberger, Lady Hale, Lord Sumption, Lord Carnwath and Lord Hodge are expected to give a definitive answer on Wednesday 25 February as to whether West Beach, Newhaven, should be registered as a town or village green under s.15 of the Commons Act 2006.
In March 2013, the Court of Appeal found that the Commons Act 2006 contained no measure to narrow the definition of TVGs so as to limit it to “more traditional village greens” and went on to overturn a high court ruling that the Newhaven beach should not be reopened to the public as a TVG.
Newhaven Ports and Properties hopes ultimately to thwart the registration that it claims prevents effective use of the port.
