A hearing date has been fixed for the appeal in Good Harvest Partnership plc v Centaur Services Ltd [2010] EWHC 330 (Ch); [2010] 14 EG 114.
The case, which cast doubt on the validity of guarantees for the period after the tenant assigns its lease, sparked a huge amount of debate following the High Court decision by Newey J in March.
Many perceived it as creating an added anxiety for landlords, which could no longer rely on the guarantees given by a former tenant’s guarantor following an assignment of the lease.
The hearing will come before Richards and Elias LJJ and the Master of the Rolls, Lord Neuberger, on 29 June.
