The High Court has upheld a challenge to plans for a third landfill operation in the village of Glapwell, Derbyshire.
Local resident John Blewett, who lives only 200m from the two existing landfill sites, had opposed Derbyshire County Council’s approval of a third site, which would extend operations until 2013 and ultimately contain 850,000 tonnes of waste.
Quashing the grant of planning permission, Sullivan J has ordered the council to reconsider their “seriously flawed” decision, stating that they had failed adequately to consider whether the scheme was the “best practicable environmental option” (BPEO).
He said: “Merely repeating the acronym, however frequently, is not an adequate consideration of the issues raised by BPEO.”
