High Court backs opposition to reopening of rat-run

A group of Barnet residents have succeeded in a High Court challenge to Barnet London Borough Council’s decision to reopen a road to traffic.

The Partingdale Lane Residents’ Association claimed that reopening Partingdale Lane, following its experimental closure in March 1997 and permanent closure in August 1998, would breach council policy against creating rat-runs and would represent a danger to pedestrians and cyclists.

Allowing the appeal, the High Court held that it was satisfied that a councillor involved in the decision had predetermined the issues before consultation had taken place.
