The residents of Duchess of Bedford House, an exclusive mansion block in Kensington, W8, have been told they can’t park on an adjoining private road following a High Court trial.
Judge Mr Justice Adam Johnson overturned a County Court ruling declaring the residents had a right to park on Sheldrake Place.
The appeal was brought by the long leasehold owner of Campden Hill Gate, a neighbouring mansion block, to assert its residents sole right to park on the road.
In his ruling, which notes that parking disputes between the two bocks predate the 1970s, he found that a change to a 1974 headlease deprived Duchess of Bedford House residents of their parking rights. The freehold owner of both properties is the Phillimore Kensington Estate.
The case was heard at a trial lasting two days in April and the ruling was handed down yesterday.
