Irish traveller must move from Brighton site

An Irish traveller has failed in her attempt to bring court action against Brighton and Hove District Council, having accused them of failing to provide her with interim accommodation after they ordered her to move her caravan from a site at Hangleton Bottom.

The Court of Appeal was told that Anne O’Donoghue made a “homeless” application to the council after the being told that she must leave the site within 30 days.

Marc Willers, counsel for Donoghue, said that she is currently encamped on land outside the council’s area in Newhaven, but that she intends to return to the site tomorrow.

Dismissing Donoghue’s application for permission to challenge an earlier High Court ruling backing the council’s decision, Wilson J said that although it was unarguable that O’Donoghue was homeless, provisions in the Housing Act 1996 did not apply to travelling owners of caravans.
