Judgment reserved in Norfolk flooding dispute

Lord Somerleyton must wait to hear whether he will have to pay damages in respect of the flooding of land neighbouring his Norfolk property.

The Court of Appeal has reserved judgment in the dispute, and is expected to give its decision in writing within the next month, although no date has yet been fixed.

John Green, the owner of Priory Farm, Fritton, has launched a challenge to a High Court decision dismissing his claim for a court order and damages against Lord Somerleyton, and others who own the marshes adjoining Priory Farm, in respect of the discharge of water onto his farm from nearby Fritton Lake.

Green seeks compensation, and a declaration that Lord Somerleyton had no right to discharge water onto his land.

Green v Lord Somerleyton and others Court of Appeal (Schiemann and Jonathan Parker LJJ and Sir Christopher Staughton) 5 February 2003.

Caroline Hutton (instructed by Mears Hobbs & Durrant, of Great Yarmouth) appeared for the appellant; Nicholas Caddick (instructed by Nicholsons, of Lowestoft) appeared for the respondents.
