Kensington “beach hut” house hits another legal setback

Red-and-white-striped-house-KensingtonA property developer fighting a legal battle over her controversial red-striped building in Kensington, SW7, has been given another setback after a London court refused her appeal over planning permission.

The Court of Appeal in London refused Zipporah Lisle-Mainwaring permission to seek the overturning of a ruling quashing planning permission. Earlier this year a lower court said that she shouldn’t have been allowed to change the building from office use to residential use.

The appearance of the building, which is painted with large vertical red and white stripes, is said to have horrified neighbours in the exclusive area, who have likened it to a circus big top and a beach hut.

She has already been served with a section 215 notice by the Royal Borough of Kensington & Chelsea ordering her to paint out the stripes or face prosecution.

The case is, however, unlikely to end soon as there are other cases relating to the building going through the court, and possibilities for appeal.
