Landlord Marylebone Warwick Balfour has launched proceedings in the High Court to close down a lap-dancing club in Birmingham.
It claims that tenant Bitz & Pizza (Fiveways Birmingham) Ltd, of Taylors Court, Rotherham Road, Gate, South Yorkshire, has breached the terms of its lease after agreeing not to use unit 4 Fiveways, Birmingham, for any illegal or immoral purpose.
According to the claim, issued at the High Court, and just made publicly available, the lease stipulates that the property should be used only as a high-quality café/bar or restaurant. It also states that the tenant had agreed not to alter the property without permission.
However, Marylebone says that Bitz & Pizza has allowed the property to be used as a lap-dancing club by its underlessee, Brooklyn Leisure (Bristol), which was granted a 25-year lease. Marylebone contends that this is an immoral use, and constitutes a breach of the lease. It further claims that such use has a detrimental effect upon the area.
Marylebone is seeking an injunction banning the Brooklyn from running the club, and from making alterations to the property. It further seeks an injunction requiring Bitz & Pizza to reinstate previous alterations.
