Maidstone Council will this week learn whether they have succeeded in their final attempt to force a local farmer to tear down a partially completed home that he allegedly constructed without planning consent.
The House of Lords is set to pass judgment on an appeal by the council against earlier court rulings in which it was held that they were not entitled to take enforcement action against Alan Sage, in respect of the development at 9ha Holly Farm, Holly Farm Road, Otham, which he bought with his wife Sharon in 1986 and on which he grew grass, fruit, and cobnuts.
Judgment is due to be given on 10 April 2003.
