New use class orders come into effect today, removing the ability of bars, takeaways and restaurants to change use without planning permission.
The Town and Country Planning Act has amended Class A3, which allows hot and cold food to be eaten on the premises but now prevents the sale of takeaway food.
A new class – A5 has been created for hot food takeaways, while nightclubs are now sui generis.
Keith Hill, minister for planning, said: “These changes will give local authorities more control to manage town centre development while minimising the negative impacts of a proliferation of pubs, takeaways or nightclubs.”
The order for change of use classes was made on 25 January and applies to England only.
