Newtown Common easement dispute moves to House of Lords

A test-case challenge by residents living near Newtown Common in Newbury, Berkshire, to moves by Bakewell Management Ltd (BML), to charge them for the right to drive over the common to access their homes has moved to the House of Lords.

The residents are seeking permission to challenge an Appeal Court ruling that backed an earlier High Court decision that Bakewell was entitled to apply the charges. The case has wide-ranging implications for many other homeowners throughout the country whose properties are similarly situated.

The Law Lords are delaying their decision, as to whether they will consider the case, until 25 April in order to give Bakewell an opportunity to prepare its objections.
