No appeal in antisocial behaviour ruling

The House of Lords has refused to allow a housing association permission to appeal a decision relating to the antisocial behaviour of one of its ex-tenants.

Medina Housing Association Ltd brought possession proceedings in respect of a property in Newport, on the Isle of Wight, claiming that the tenant had breached the tenancy agreement by engaging in antisocial behaviour towards neighbouring tenants.

The trial judge had granted possession of the property, as well as a continuing injunction that banned the defendant from further antisocial behaviour towards her ex-neighbours. The Court of Appeal, however, quashed the injunction on the basis that it could not be extended beyond the termination of the tenancy agreement.

The House of Lords has now upheld the Court of Appeal ruling and refused permission to appeal. No reasons have been given for its decision.
