When working towards a fair rent from what would have been obtainable in the unregulated sector, a rent officer cannot deduct such element of the latter as may be attributable to the possibility of voids: see Spath Holme Ltd v North Western Rent Assessment Committee [2001] EWHC Admin 541; [2001] 46 EG 181.
Whether this decision will benefit a particular landlord will of course depend on the application to his case of the capping provisions of the Rent Acts (Maximum Fair Rent) Order 1999.
