Comparative leasehold systems
Q  I need a snapshot of the major differences between Continental leasehold systems and our own. Do I have to go on some overpriced course?
A  Save your money and settle down with Not so common leasehold market Estates Gazette 8 September 2001, p176. Penned by Charles Romney and Sally Badham, of CMS Cameron McKenna, the article offers a well signposted trip through various areas of likely concern. These include privity, length of term, rent review, alienation, repairs and termination.
One commercial conclusion that has been drawn is that the UK is at the very bottom of the list when it comes to the flexibility available to office users in large city centres: see “An issue that will just not go away” Estates Gazette 18 May 2002, p206, commenting on a new research publication from the British Council for Offices.
Comparatively speaking, the UK user gets the worst bargain in terms of length of lease, the denial of rights to break, and upwards-only rent reviews. It comes as no surprise to learn that investors see the UK property market as the most “mature” of those examined by the researchers.
