In the context of Class D2(e) of the 1987 Use Classes Order (“swimming bath, skating rink, gymnasium or area for other indoor or outdoor sports or recreations”), an activity cannot amount to a recreation without the need for some physical exertion: see the Court of Appeal decision in Rugby Football Union v Secretary of State for Transport, Local Government and the Regions [2002] 30 EG 134 (CS), rejecting a submission that Twickenham Stadium could be used for concerts, without the need for planning permission.
