It need not be Heartbreak Hotel
Legal issues arising on the purchase of any valuable commercial property can be particularly acute when you are dealing with an hotel.
As explained by Sebastian Charles and Zara Greenwood, of Norton Rose (see Check in early to avoid frustration Estates Gazette 31 August 2002, p93), the practice of using hotels for receptions, conferences and other non-residential activities calls for extra care in checking for necessary consents from planning authorities and (where material) superior landlords. The more delightful the establishment, the greater the likelihood of finding that the building is listed or located in a conservation area.
Ask yourself whether parts of the building occupied by staff, or by an independently operated business (eg a beauty salon). If so, the precise status of the occupiers has to be ascertained.
Other matters considered by the writers include environmental investigations, the transfer of employment undertakings, and the warranties, if any, given in respect of recent works of refurbishment.
