Busy times ahead for LVTs
Rushing off to the wrong court is hardly the best way to implement a threat to take proceedings. In the residential leasehold field, the chances of such a mishap can only multiply on the eventual bringing into force of Chapters 5 and 6 of the Commonhold and Leasehold Reform Act 2002, which provide for a dramatic expansion of the jurisdiction of leasehold valuation tribunals.
The biggest changes can be expected in disputes over forfeiture, lease variation, and the new no-fault right to manage. These and other features of the enlarged LVT jurisdiction are usefully summarised in The enforcer Estates Gazette 19 October 2002, p63. In an interview with Lucy Barnard, Siobhan McGrath, senior president of the Residential Property Tribunal Service, explains how the service is dealing with the inevitable problems of recruitment and training.
