Freeing council land of recreational trust
Provided that they follow the procedure laid down in section 123(2)(B) of the Local Government Act 1972, a local authority can make a commercial disposal of land that is subject to a charitable trust for recreational purposes: see Bath and North East Somerset Council v Attorney-General [2002] EWCA 1623 (Ch); [2002] NPC 111, as discussed by Peter Keith-Lucas, of Wragge & Co, in Set the right example Estates Gazette 26 October 2002, p197.
