Old mineral-working permission – Determination of conditions
If you are not wholly familiar with Schedule 13 to the Environment Act 1995, entitled “Review of Old Mineral Planning Permissions”, then the options are to:
* refer the file to someone who talks of nothing else;
* set aside two weeks for research;
* defer your decision until you have digested R (on the application of Payne) v Caerphilly County Borough Council [2002] 17 EG 155 (CS), which is directed to para 9 of the Schedule, entitled “Applications for approval of conditions and appeals in cases where the conditions approved of are not those proposed”.
