Action against individual: Law draws line at company directors
Employed surveyors and other professionals, already concerned about the risk of a negligence action taken against them as individuals (see PP 2001/14 and Nowhere to run to Estates Gazette 31 March 2001, p147), will hardly be too pleased to learn that a company director, otherwise similarly placed, can frequently shield himself behind principles of company law.
This, together with other anomalies arising out of Bradford & Bingley plc v Hayes Dunphy & Hayes Ltd unreported 25 July 2001*, is crtically considered by John Murdoch in Attention to duty Estates Gazette 1 February 2003, p143.
