Q  Where an environmental impact assessment (EIA) is otherwise required because a proposed site is heavily contaminated, can the developer sidestep this requirement by submitting with its planning application detailed proposals for remediation measures?
A  No: see Gillespie v Secretary of State for Transport, Local Government and the Regions [2003] EWHC 08 (Admin); [2003] PLSCS 9, as discussed by Martin Edwards and John Martin in A stitch in time Estates Gazette 8 March 2003, p161.
