While parties in more adversarial types of litigation have made the most of settlement offers under CPR Part 36, many still question whether such an offer would be helpful when dealing with an unopposed lease renewal.
Emma Humphreys, of Charles Russell, in her article Part of the problem Estates Gazette 9 August 2003, p62, maintains that more landlords and tenants should consider the usefulness of making a Part 36 settlement offer. She looks at the benefits of such an approach, before going on to address the difficulties in situations where the Part 36 rules do not quite fit with unopposed renewal proceedings.
