Landlords and tenants may have to review their position in the light of the forthcoming changes to Part II of the Landlord and Tenant Act 1954.
The Regulatory Reform (Business Tenancies)(England and Wales) Order 2003, which comes into effect on 1 June 2004, is intended to make the renewal of business tenancies quicker, easier, fairer and cheaper.
For an analysis of the effect that the reforms will have on procedures, check out A healthier alternative Estates Gazette 28 February 2004, p136. In this article, Catriona Smith and Peter Reekie discuss the new contracting-out provisions and the changes to notice procedures.
See also Hazel Williamson QC’s article Seemingly insecure solution for some Estates Gazette 7 June 2003, p131, in which she sets out her misgivings regarding the provision that will make it easier to contract out of a business tenant’s statutory right to security of tenure.
