Imagine a house that has stood for centuries. It has been altered on countless occasions, in a variety of styles, and for reasons now forgotten. Everything in the house just about works, but it isn’t easy to maintain or live in. The present law surrounding the forfeiture of leases is rather like that old house.
Proposals for change have been made before, but now the Law Commission has published a consultation paper called Termination of Tenancies on Tenant Default. If the proposals become law, the entire present law would be swept away, and a new, rational, statutory scheme established instead: the picturesque old house would be demolished, and a modern, convenient dwelling would take its place. We are probably a few years away from these changes, but watch this space. Details of the proposals can be downloaded here.
