A group of showmen who purchased land in south-west Surrey and set up permanent quarters without planning permission have been ordered to vacate the site.
The High Court had previously granted the showmen an extended period of time within which to leave the property, which is designated for agricultural use. However, Stanley Burnton J yesterday refused to allow a further extension.
The showmen had sought a suspension of the injunction on the ground that a revised planning application, relating to a smaller-scale development of the site, had been submitted.
But the judge ruled that the revised application for planning permission did not amount to a relevant change in circumstance, and ordered the showmen to vacate the site within 10 days.
Waverley Borough Council v Lee and others Chancery Division (Stanley Burnton J) 6 March 2003.
Joseph Harper QC (instructed by Rees & Freres) appeared for the claimants; Marc Willers (instructed by Martin Nossel & Co, of Basildon) appeared for the defendants.
