A London landowner has brought proceedings against Linden Homes (Chiltern), claiming that the developer has obstructed access to his riding stables, causing his horses to become terrified to the point of illness after being left to wait in horseboxes.
Andrew Reid, of Highwood Lodge, Highwood Hill, Mill Hill, London NW7, maintains that the company obstructed his access to Belmont Riding Stables despite the fact that there is a full right of way for horses, carts, and other vehicles to use a private road leading to them.
He argues that Linden Homes has breached an agreement made in June 2001, in which the developer had agreed to erect traffic signs for the stables, to inform residents to give priority to horseboxes on the road, and to ban roadside parking.
Reid is seeking, among other things, an order prohibiting Linden Homes, and its agents and contractors, from hindering or obstructing the access of horses, carts and vehicles together with an order forcing the developer to keep the right of way clear. He is also seeking damages and repayment of vehicle-cleaning costs arising from the development.
