The appellant engaged the respondent buyer’s agent to assist him in purchasing a house. The agency contract, on the respondent’s standard terms, required the payment of an initial £500 registration fee with a further commission of 1.5%, or 15% of the difference between the asking price and price paid, in respect of any property upon which contracts were exchanged during the continuance or within one year of the termination or expiry of the agreement. The agreement set out a number of events in which the respondent would be deemed to have introduced a property to the appellant.

The respondent prepared a list of properties for the appellant, including the property that he eventually purchased. Although the appellant was initially unenthusiastic about the property, it was later recommended to him by a planning consultant whom he had engaged. Although the property had by that time been taken off the market, the consultant contacted the owners, who subsequently accepted an offer from the appellant. After the sale was completed, the respondent made a claim to recover its commission. The appellant contended that no fee was payable because the respondent had not been the effective cause of the purchase, which had come about solely through the planning consultant.
